Sidemen x Gemini Prize Draw Terms and Conditions

1. These are the terms and conditions (the "Terms") for the Gemini prize draw (the "Prize Draw"), run by Sidemen Entertainment Limited, company number 12349593, of Amelia House, Crescent Road, Worthing, West Sussex, BN11 1RL ("us" / "our"/”we”). By entering, you agree to these Terms.
2. The prize is one bundle made up of a Sidemen Signed Hoodie, a Google Nest Hub Max, a Google Home Speaker and a Google TV Streamer (the “Prize”). One winner will receive the whole bundle.
3. The Prize Draw is organised, administered and promoted solely by Sidemen Entertainment Limited. Google LLC, Google UK Limited and their affiliates are not promoters of the Prize Draw and accept no liability in connection with its administration, winner selection or prize fulfillment. It isn't sponsored, endorsed or administered by Google, or by any social media platform we promote it on. Sidemen Entertainment Limited will be responsible for contacting the winner and arranging fulfilment of the Prize. Google has no responsibility for delivery, replacement, winner communications or any other aspect of prize fulfilment.
4. The Prize Draw is open to UK residents aged 18 or over at the date of entry.
5. Employees, officers and directors of Sidemen Entertainment Limited, its group companies, Google LLC, Google UK Limited and their respective affiliates, and any person directly involved in the organisation, administration or promotion of the Prize Draw, are not eligible to enter. The same exclusion applies to their immediate family and members of their household.
6. The Prize Draw opens at 19:00 BST Sunday September 20th and closes at 19:00 BST Friday September 25th (“Promotion Period”). Entries received after this time will not be counted. 
7. Sidemen Entertainment Limited will collect and process entrants’ personal data as data controller for the purposes of administering the Prize Draw, verifying eligibility and contacting the winner. Google will not receive or host entrant personal data. Personal data will be retained for no longer than necessary: non-winners’ data will be deleted within three months after the Promotion Period ends, and the winner’s data will be deleted within one year, subject to any longer period required by law or reasonably necessary to deal with disputes or regulatory obligations.
8. To enter the Prize Draw, entrants shall be required to enter accurate details in the sidemen.com/giveaway landing page, and provide full name, email address, telephone number and confirmation that they are aged 18 or over and a resident in the UK. No purchase is necessary to enter.Entries submitted outside the Promotion Period will not be valid. Only one entry per person is permitted. If you submit, or appear to submit, more than one entry, including through duplicate accounts or by using multiple email addresses, we may invalidate all entries submitted by you and disqualify you from the Prize Draw. Entries must be submitted during the Promotion Period. Any entry received before the opening time or after the closing time will be invalid and will not be counted.
9. You must provide accurate and complete information. We may disqualify any entry where we reasonably believe that the information provided is false, inaccurate, incomplete or misleading.
10. Entry to the Prize Draw is free. You are responsible for any internet access, mobile data or other costs you incur in submitting an entry.
11. The Prize is non-transferable and cannot be exchanged for cash or any other alternative. No cash alternative will be offered. The selected winner must provide reasonable proof of their identity, age and UK residency if requested by the Promoter. The Promoter may withhold delivery of the Prize until the winner’s eligibility has been satisfactorily verified. If the selected winner fails to provide the requested evidence within seven days of the request, or if the evidence shows that they are not eligible, they will forfeit the Prize and an alternative winner may be selected in accordance with these Terms.

12. By entering, you agree that we may collect and use your personal information to administer the Prize Draw, select and contact the winner, and arrange delivery of the Prize, in accordance with our Privacy Notice. We will only collect the minimum personal information reasonably required to administer the Prize Draw, namely your full name, email address, confirmation that you are aged 18 or over, and confirmation that you are resident in the UK. We will not use your personal information for marketing purposes unless we have obtained your separate consent. We will retain entrants’ personal information only for as long as reasonably necessary for the administration of the Prize Draw and related legal or regulatory purposes. Personal information relating to non-winning entrants will be deleted within three (3) months after the Promotion Period ends. Personal information relating to the winner will be retained for no longer than twelve (12) months after the Promotion Period ends, unless a longer retention period is required by law or is reasonably necessary to resolve a dispute or comply with a legal obligation.
13. By entering, you agree we can collect and use your personal information to run the Prize Draw and contact the winner, in line with our Privacy Notice. We will not use your details for any other marketing purposes without obtaining permission.
14. We reserve the right to cancel, suspend or amend the Prize Draw where reasonably necessary, including where circumstances arise beyond our reasonable control, or where the Prize Draw cannot be operated as planned. We will not exercise this right except where necessary and, where reasonably practicable, will notify entrants of any material change or cancellation. We may disqualify an entrant or invalidate an entry where we reasonably believe that the entrant has breached these Terms, provided false or misleading information, interfered with the operation of the Prize Draw, attempted to obtain an unfair advantage, or engaged in fraud, dishonesty, deception or other improper conduct. The Prize Draw and these Terms are governed by English law. The courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or in connection with the Prize Draw or these Terms.
15. We will not be responsible for any loss or damage suffered by an entrant in connection with entering the Prize Draw or using the Prize, except to the extent that the loss or damage results from our negligence, breach of these Terms, fraud or other unlawful act or omission.Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these Terms affects your statutory rights as a consumer. The Promoter is not responsible for any loss or damage caused by a defect, misuse or failure of any item forming part of the Prize, except to the extent that such loss or damage results from the Promoter’s negligence, breach of these Terms or other unlawful act or omission.
16.  We will not be liable for any delay or failure to perform our obligations under these Terms where the delay or failure results from circumstances beyond our reasonable control. This may include, for example, technical failures, internet or platform outages, natural disasters, government action, industrial disputes or other events that could not reasonably have been anticipated or avoided. We will take reasonable steps to minimise the effect of the event and resume performance as soon as reasonably practicable.
17. To comply with applicable advertising rules, we may make the winner’s surname and county available to anyone who requests this information by emailing francesca@arcade.media within three months after the Promotion Period ends. As the Prize Draw is open only to UK residents, the county will be a county within the United Kingdom. A winner may object to the publication or disclosure of this information where they have a genuine privacy or safety concern. Any such objection should be raised with the Promoter at the time of entry or as soon as reasonably practicable after being notified that they have won. Where a winner objects, we will not publish or disclose their personal details and may instead confirm to a legitimate requester that the Prize Draw was properly administered, subject to applicable data-protection law. The winner’s personal information will otherwise be handled in accordance with our Privacy Notice.
18. If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified to the minimum extent necessary to make it valid and enforceable. If it cannot be modified, it will be removed, and the remaining provisions will continue in full force and effect.
19. These Terms and the Prize Draw are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or the Prize Draw will be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in this clause affects any mandatory rights you may have as a consumer under the laws of the country in which you live.
